The clerk can provide copies of wills, fiduciaries, and other estate-related records for a small per-page fee.

The City of Franklin is surrounded by Southampton County and Isle of Wight County. Before the city became independent in 1961, records for deaths in this area would have been filed with one of those counties depending on the exact location. For pre-1961 research, check both county records. Southampton County records date back to the colonial era. Isle of Wight County was formed in 1634 and has one of the oldest continuous record sets in Virginia.

Probate cases in Virginia typically open within a year of a person's death. The executor files the will and related documents with the Circuit Court Clerk, who then qualifies the executor and oversees the estate settlement. Land records help trace property transfers that follow a death, identifying heirs and confirming death dates. Marriage records at the clerk's office help establish family connections for restricted record access.

Franklin Death Index: Historical Research

The City of Franklin became an independent city in 1961. Deaths before that year in what is now the city would be recorded under Southampton County or Isle of Wight County. Virginia's first period of statewide death registration ran from 1853 to 1896. Records from that era for this area would be indexed under one of those counties in the Death Index of Virginia, 1853-1896, which was sponsored by the Virginia Genealogical Society.

The death registers from 1853 to 1896 are on microfilm at the Library of Virginia. Virginia residents can access them for free through Ancestry for Virginians at lva.virginia.gov. From 1897 through June 1912, Virginia had no statewide death registration. For deaths in the Franklin area during that gap period, church records, probate files, and newspaper obituaries are the best options.

FamilySearch has free Virginia death and genealogical databases at familysearch.org. Some Southampton County and Isle of Wight County collections are available online. Cemetery records for the Franklin area have been indexed by genealogical volunteers. Obituaries in local newspapers like the Tidewater News can provide additional death information beyond what the certificate holds.

Southampton County has historically significant records. The county was the site of the 1831 Nat Turner rebellion, and its records from the antebellum period are well-preserved at the Library of Virginia. Isle of Wight County records from the 1600s and 1700s are among the oldest in Virginia. For researchers tracing families back through multiple generations, these county records provide context that the city records alone cannot supply.
