Poquoson Circuit Court and Probate Records

The Poquoson Circuit Court handles probate cases, wills, estate administration, land records, and marriage licenses for the City of Poquoson. It does not issue death certificates. Those must come from the state Office of Vital Records. Because Poquoson has only been independent since 1975, the city's own court records cover a relatively short period. All older records are in York County.

You can search court case records for free through the Online Case Information System (OCIS). For records that predate the online system, contact the Poquoson Circuit Court Clerk. Land records at the clerk's office track property transfers after a death. Deed entries often name the deceased and identify heirs. Marriage licenses are also available through the clerk.

For deaths that occurred before 1975 in what is now the City of Poquoson, the York County Circuit Court holds those records. York County was formed in 1634 (originally as Charles River County) and has some of the oldest continuous court records in Virginia. Probate records from York County going back to the 17th century are at the Library of Virginia and accessible through FamilySearch. If your research goes back further than 1975, York County is the starting point.

Poquoson is a small coastal city with a fishing and watermen tradition. Church records from historic coastal communities in this area have been microfilmed and are available through genealogical databases. The Williamsburg Regional Library serves some of the surrounding area and has local history resources. For Poquoson-specific materials, the city clerk's office can help with very local records, and York County's resources cover the pre-1975 history.

Poquoson Death Index: Historical Research

Poquoson became an independent city in 1975. All deaths before that year in the current city area are in York County records. Virginia's statewide death registration ran from 1853 to 1896. Deaths from that period in this area are indexed under York County in the Death Index of Virginia, 1853-1896, sponsored by the Virginia Genealogical Society. These death registers are on microfilm at the Library of Virginia.

From 1897 through June 1912, Virginia had no statewide death registration. For deaths in the Poquoson area during that gap period, church records, probate filings, and newspaper notices are the main alternatives. The Poquoson area's watermen community kept some informal records through churches and community organizations. York County had limited local death registration during the gap period, so coverage from those years is incomplete.

Virginia residents can access many records for free through Ancestry for Virginians at lva.virginia.gov. FamilySearch at familysearch.org has free Virginia genealogical databases. York County records, which cover the Poquoson area through 1975, are available through both platforms. Cemetery records for the Poquoson area have been indexed and are searchable through FindAGrave.

Because Poquoson is a coastal community, maritime records may be relevant. Deaths at sea or in connection with watercraft are documented through Coast Guard records and maritime accident reports. Those records are at the National Archives. For researchers tracing Poquoson watermen families, combining church records, probate files, maritime records, and the official vital records databases gives the most complete picture of 19th and early 20th century deaths in this area. Federal mortality census schedules from 1850 to 1880 are held at the Library of Virginia and list York County residents, including those in the Poquoson area, who died in the twelve months before each census. These schedules are searchable through Ancestry and complement the official death registers for the 1853-1896 period.
